Government Consultation on Employment Relations Act

The government is consulting on two parts of the Employment Relations Act: personal grievances and the transfer of employees. We will be making submissions to government and attending the select committee hearing on personal grievances to speak to those submissions.

We would like to hear your views on how the Act is working – both good and bad. As we act mainly for employers, we see this as an important opportunity to formally express the concerns you voice to us anecdotally, and for you to be heard on how the Act really works.

Property Matters - Unit Titles Bills Progresses
The Unit Titles Bill received its second reading in Parliament last week following review by the Social Services Select Committee.

The Bill is intended to modernise the establishment of unit title developments and the management of these. It repeals and replaces the Unit Titles Act 1972 in response to the growth in apartment style living that has occurred in New Zealand over the last 30 years.

Is the Authority soft on drugs?
Two recent decisions from the Authority suggest that recreational drug use is acceptable.

McLeod v Transfield Services Limited
Mr McLeod, a “vegetation worker”, was so relaxed he fell out of a tree. His employer, Transfield, following its usual procedure, tested for drugs, and Mr McLeod tested positive for cannabis.
Following a disciplinary investigation, during which Mr McLeod was offered and accepted EAP assistance, Mr McLeod was dismissed for serious misconduct.

The Climate Change Response Amendment Bill
On 25 November 2009 the Moderated Emissions Trading Scheme was passed by Parliament. The Moderated Scheme departs from the Scheme originally enacted last year by amending the date of entry for several sectors and providing a transitional phase in which the price of units is fixed.

TAURANGA'S PROPOSED CITY PLAN – The Good, The Bad and The Urban Design Rules
Tauranga City Council is currently in the process of reviewing its district plan. The Proposed City Plan was notified on 17 October 2009. Councils are required by law to review any provision in their district plans that has not been reviewed in the previous ten years. This presents a great opportunity for residents and businesses in Tauranga to submit on the Proposed Plan in respect of a number of issues including zoning, heritage, landscape and amenity areas and hazard areas. The City Plan creates a number of new zones within the city aimed at intensifying development and in the City Centre there are new Rules with an urban design focus. Submissions on the Proposed Plan close on 15 December 2009.
